The Saga continues

Perhaps you saw my post from a month or so ago about never receiving some of the parts we purchased from Thomas Miller, a member who lives in PA. Well, we still have NOT received the remaining parts. His latest claim was that the stuff (steering wheel, hub adapter, front brake calipers) were lost by FedEx and that they paid him insurance money with which he purchased new items and sent out to my address two weeks ago tomorrow. I have emailed him several times and tried both phone numbers several times to no avail. I just sent him an email letting him know my plans to file a complaint with his local police department for mail and internet fraud. Its a shame that people try to rip other people off, especially in a community such as Spec E30. Sorry to rant.:angry:

did you try the local TV news station?
We have channel 3 NBC which has a thing called call 3.It works good in these situations.
Also try the better business bureau.
I would just show up early in the morning and demand my money back.

I’m sure you’re more than agravated to the max, and I don’t blame you. Unfortunately, such incidents are usually viewed as civil matters of a debt owed rather than theft, and law enforcement will likely not take much interest. You may be left with the less attractive alternative of suing in his jurisdiction. Hopefully, he will still be sensitive to some semblance of not wanting to be the pariah of specE30. I for one do not blame your rant. I know others in prior posts opined that this was not the place for your woes. I disagree. Glad you aired it here.

Tom,

I can’t believe that you still have not received your parts or your money back. This guy needs to save what’s left of his reputation and make good on his end of the deal. At this point the only thing that I would want is my money back.

Good luck getting something out of this guy.

PA is a long way from SC, so dropping by is not really an option. I’m really surprized that he is doing this when he intends to be involved in SpecE30 in the future. Thanks for the remarks, I’ll post if / when I have any updates.

Hate to hear you’re having this problem.

What’s this guys username and/or what other names does he go by on all the boards.

As someone who buys lots of parts online… I’d like to avoid this guy.

Tom, I hope you’re just venting. With all the Tom Miller’s you’ll end up having the wrong person harassed.

Will get resolved… stop trying to sell the community a bridge where a twig has fallen across a puddle…


And about my house, too far with a wife and kid folks. If I am home, I will not be polite and it wouldn’t help Tom Hall any.

Of over $3k worth of parts, one box with a <$200 steering wheel, $50 hub and cheap rebuilt calipers went missing. I bought another wheel and hub, and pulled my calipers, sent to Tom.

On travel with a work laptop, couldn’t check email. Hard-coded Proxy logged internal and external, against company policy and fireable offense. Got home last night and hung with my wife, check email while she was at work this morning… oh what fun… I am trying and will go to USPS to request an investigation on Monday morning. I tried today but missed them before they closed.

If I was scamming someone, I would’ve sold on ebay, or something else. Tom sent an email implying that perhaps I believe he underpaid, and I am just withholding. Untrue.

This sucks just as much on this side… it’s costing money but even more, piece of mind about the security of my family while I am on travel. This is bullshit, I’ve used one SN since '03, everywhere… I’ve never scammed anyone and I am not scamming Tom Hall.

Whoa there tough guy. Sounds to me like you disappeared for a while and were no longer communicating with someone you sold some parts to- a fatal error in this age of online scammers all over the place.

Based on this thread,
I do not think anyone made any threats against you or your family- other than to try to find out what the hell was going on- maybe hoping that they could get some resolution by speaking to you face-to-face.

If you’ve had such horrible luck with the USPS, maybe offer the guy a partial refund for the parts lost?

I’ve bought and sold plenty of parts online- using Ebay and BMW-related forums mostly, and as much of a PITA as it can be, the way I see it, the seller is responsible for getting the parts into the buyer’s hands as promised, none of this crap you often see about &quot;not responsible for items not insured&quot; or trying to get off the hook by saying it’s the shipping company’s fault if the item(s) get lost. Not saying this is what you’re trying to claim, but the way I see it, the responsibility is yours to take care of something like this ASAP, and to maintain close contact with the buyer until it’s resolved. If you &quot;disappear&quot; for a couple of days or weeks without any contact- the buyer assumes he/she has been scammed and, as in this case, something like this thread is usually the result.

But, I’m glad this did not turn out to be another case of someone trying to scam someone on this board. I hope you guys can come to a reasonable agreement about the missing parts.

Thanks Bret for your support but this is just bull#@*&! Tom and I (Jeff, his brother) have tried over and over to communicate with Thomas and he ALWAYS drops out of sight! ALWAYS!!!

He put’s on this big effort to call us and then promises to send it and then NOTHING! We agree with him on one point only, why would you be playing games with us on this little BS? I figure your just really bad at doing what it takes to finish a job.

We have given you many opportunities to deal str8 with us and never works out. We would take a refund, we’d even believe you if we ever saw a tracking number or reciept, but nope, none of the above.

Bottom line, we thinks your full of $#@* and personally I don’t care what happens, but my Brother is more of a bull dog then I am. I’ll just talk trash about you to anyone willing to listen.

You even told us you had gone out and replaced the lost stuff, at a higher cost to you, just to send it to us. Now that is missing too! Then when we said, &quot;Send us back $350 refund&quot; you start with, well that isn’t what it was worth. Seems like that was what it was worth on your orginal spreadsheet, right?

Bottom line is this, NO ONE should EVER trust this guy again! Ever, end of story. Sorry if that hurts dude, but we’ve tried more then enough.

And about the tight proxy server you get email thru, your email account is at Comcast. Try webmail.comcast.com sometime asshole!

Jeff, sorry you’re upset. I understand. I do, and I am sorry.

The proxy, it tracks what we use work computers for internet-wise. I cannot, because of company policy, use the computer to check comcast while on travel. I am sorry that prevents immediate responses to help resolve this, but that’s what it is.

On the spread sheet I showed what I paid in total. You guys negotiated down from that, then are willing to accept full cost of the parts that I paid, I offered that if it comes to that, you paid 2500 on 3100… why should I send you 100% of what I paid for the part? I’d be willing to send you 80 or 85% of list, if that’s what it comes down to.

I am doing my best, I am not a parts reseller, I sold my parts for my spece30 to cover a tax error (on my part). Like I said to Tom today, &quot;I can’t make the stuff materialize, but will fix it&quot;. Don’t know what to do beyond that.

The &quot;tough guy&quot; comment. I understand what you’re saying, Bret. Tom Hall made a comment to me about &quot;talking&quot; at the track over this mess. Just pointing out there should be a line drawn at %&$*ing with peoples families. It’s where I draw mine.

This will be resolved… by parts or money.

Tom & Jeff, Carter, Chris and my friends, the community as a whole, I am sorry this occured, and I have to say that even I would have trouble believing the crap that has happened if I were Tom or Jeff. Tom and Jeff, I am sorry.

On Monday I went to the post office, and asked about the package I had sent to South Carolina. The fellow that took the package initially was behind the counter, knew what package I was talking about, and knew where it was. This fellow then told me the package was undeliverable.

In complete disbelief, I asked why, trying to contain the rage building inside me. When moved, contents shifted, basically.

So, I asked why it was not returned to my house. My address was on package. It’s a small town, I am only two blocks away from the post office. &quot;You have no mailbox&quot;. My mailbox was destroyed by a snowplow. I replied, &quot;It’s a box. It wouldn’t fit in the mailbox. I filled out a form requesting that packages be placed inside the rear porch when I moved it.&quot; This kind man replied, &quot;No mailbox, no mail.&quot;

I pointed out that both I, and my wife had been in to pickup our mail since the mailbox came down. His response, &quot;I don’t know. Sorry.&quot;

I re-packaged and shipped the box Second Day air via FedEx at the BWI Global Services Center on Monday evening after work. I called Tom immediately, and gave him the tracking number.

As long as I have been participating in on the automotive and motorsports forums, when I found, encountered or heard of a scammer, I’ve actively pushed the issue, and conveyed the information, screen names, name, address, victims. I never imagined I’d be in this position, and again, I apologize.

Tom and Jeff, please forgive me for becoming defensive. And again, I am sorry for the trouble related to this last portion of our transaction. No matter the circumstances or unforeseeable issues, I am the one who was shipping the parts, and needed to be more aggressive about the issues, despite conflicts with work, or lost parts.

Finally, I am sorry. And I am still working on work, so I am not re-reading this or spell checking it, so please forgive that as well.

Tom said he would call when the parts arrived. I shipped 2nd Day Air after talking to Tom and hearing that he would like to have them before the weekend, even though he said there was no need to do so. Tom, I look forward to receiving that call.

Jeff, I understand you are a very calm and reasonable person, and not likely to directly call someone an asshole. I am sorry that I got you so upset.

Looks like this has been settled- Catsailor, can you confirm receipt of the last batch of parts??

Glad to know that Nukblazi is not a scammer :slight_smile: And the USPS continues to amaze with their &quot;mysterious&quot; ways.

Unfortunately, people continue to be scammed on a daily basis, and it’s not unheard of for a previously upstanding member of the BMW community to suddenly become a scammer and then fall off the face of the earth.

Once again, communication is key- I don’t think I’ve ever been concerned by a seller giving me TOO MUCH information when it comes to an internet transaction.

Anyway, I’m glad this worked out (apparently) and hopefully there are no hard feelings…
